    What is stunt driving anyway?

    Have you ever had the compelling urge to push your v-8 engine to its limits? Have you ever felt that speed limits were made for grandmas, grandpas and people still learning how to drive? Have you ever felt like Dom (Vin Diesel) from fast and furious? If your answer is yes to at least one of the questions, then this piece is for you. Stunt driving in Ontario is a common drivers’ sickness, and if you get caught, then you might be in some big trouble. So, you might want to rethink your formula-one grand Prix ideas before you get pulled over by the police.

    Marked Departure From Lawful Speed Rate:

    Are you driving off a cliff? Are you driving on only two tires on one side of the car? Interestingly, stunt driving can be something as simple as going over the speed limit over 50 km/h. What this means is that you can get a speeding ticket in Ontario for driving above the border, but if you are unlucky you can get slapped with a stunt driving ticket.

    The thing is: most people do not have a clear idea of what stunt driving is, more interesting is that they also do not realize that they are massively exceeding the speed limit. When they do get caught, they even do not know what the law has in store for their offence. We shall address these issues here. Let us start with what offences may be qualified as stunt driving in Ontario.

    According to section 172 of The Highway Traffic Act of Ontario, a driver is eligible to be written a stunt driving ticket if he or she is caught driving at a speed more than fifty (50) Kilometers per hour (Km/h). But this isn’t the only situation that may warrant issuance of a stunt driving ticket in Ontario. There is a myriad of possible situations. An officer may issue a driver a stunt driving ticket if they are caught in any of the following circumstances:

    • Sporadically changing lanes while near other vehicles in an attempt to elude or outpace the normal flow of traffic while driving at a speed that is considered above the legal speed limit.
    • Driving in such a way as to suggest an intention to chase, catch up or unlawfully overtake another vehicle.
    • Two or more drivers are driving in a manner that indicates that the drivers of the cars are engaged in a race or competition.
    • Attempting to outdistance or outdistancing other vehicles in traffic while driving at a speed that is a departure from the lawful speed limits.
    • Driving without due concern for or consideration of other road users in traffic including drivers or any other pedestrians or passersby.

    Of course, stunt driving may include the more Hollywood scenarios like:

    • Driving with a person in the trunk.
    • Driving with the intention or in a way that indicates an intention to cause the vehicle to spin or turn a circle without maintaining full control on it.
    • Slowing down or stopping your vehicle in a way that indicates or suggests an intention to stop or slow down another car or to obstruct the passage of said vehicle by interfering with the typical path of the said vehicle causing it to slow down or stop in a circumstance where it would not usually stop or slow down.
    • Driving in a manner that indicates an intention to produce all or some tires to lose traction with the surface of the road while making a turn.
    • Driving without seating in the driver’s seat.
    • Driving dangerously close to another vehicle, pedestrian or fixed object on a highway without any apparent justification
    • Driving two or more vehicles side-by-side on a road where one of the vehicles is on a lane or portion of the way that is rightfully intended for oncoming traffic for a time longer than is reasonably justifiable for one car to overtake the other.
    • Driving to lift one or more tires off the ground, this includes riding a motorcycle in a way that one wheel is not in contact with the ground.

    Marked Departure From Lawful Speed Rate:

    A marked departure from the statutory speed rate is another circumstance that can lead to you getting a stunt driving ticket in Ontario. It is defined as a situation in which the driver is driving at a speed which does not allow them to adjust to changes in flow or circumstances of traffic effectively.

    In terms of left turns:

    A stunt driving ticket might ensue if:

    • The driver is stopped at an intersection due to a red traffic indication on the traffic control system at the intersection, and
    • There is at least one other vehicle on the opposite side of the intersection also stopped in compliance with the red light on the traffic control system, and
    • The driver executes a “rushed” left turn immediately before or after the traffic indicator turns green in an attempt to complete the left turn before the vehicle(s) on the opposite side of the intersection can proceed straight through the intersection in response to the same green light.

    Now we have clearly defined what stunt driving in Ontario is, you might want to think twice when next you are in the driver’s seat and feel the urge to drive erratically because stunt driving goes beyond just speeding and will likely get you more than a speeding ticket in Ontario. You could get in way more severe trouble for stunt driving in Ontario.

    Some Things You Probably Do Not Know But Should Know About Stunt Driving

    1. Stunt driving will get your license taken away

    If you get pulled over by an officer of the law for stunt driving, then know that your license will be taken away from you. Following that, your license will be suspended for 7 days, and you will have to pay a fine of $180 at the ministry of transportation to get it back.

    1. The Fine for stunt driving is two times that for drunk driving

    The government frowns heavily on stunt driving; so much so that the fine you will pay for stunt driving is twice what you would have to pay for driving under the influence, and that’s saying something. As a first time offender for drunk driving, you will be fined $1000, but for stunt driving, the fine comes in a minimum of $2000 and can go up to a whopping $10,000.  The fine for stunt driving is more than you will be charged for say Seatbelt violations or turn/unsafe turn violations. To make things even worse, you could end up spending six months in jail and having your license suspended for up to two years.

    1. Stunt driving will get your car impounded for 7 days- even if it’s not your car

    The law doesn’t go easy on Lewis Hamilton wannabes pulling stunts in open traffic and endangering the lives of other innocent, law-abiding road users. If you get caught stunt driving, your car will get taken away from you—for seven days. It doesn’t matter if it is your car or your mom’s car. The owner of the car will have to pay the fees for towing as well as the cost of keeping the car at the impound for all seven days.

    1. Putting a passenger in the trunk also counts as stunt driving

    Sometimes, drivers, especially reckless teens, may want to put a friend or friends in the trunk because they are short on seats in the vehicle. Crazy as this may seem, it does happen, and it is considered a stunt driving offence as well.

    Like every other traffic infringement, stunt driving tickets are things that can easily be avoided by merely obeying traffic rules and not trying anything crazy, yet people get caught all the time stunt driving. Most times, they don’t even know that what they are doing is stunt driving, but they certainly do know that they are not driving normally or as expected by traffic laws.  As a rule of thumb, you should not drive in a way that you wouldn’t if you knew an officer was watching you.

    Is Stunt Driving A Criminal Offense?

    Although the law frowns strongly on stunt driving, it is however not a criminal offence and therefore will not go on your criminal record. It will, however, go on your driver’s record as is expected of course.

    Stunt driving doesn’t fall under criminal law but rather falls under the jurisdiction of the Ontario Highway Traffic Act. Despite this, the penalties are still quite severe, and the chances are high that you will be arrested for it.

    In addition to this, stunt driving will land you with a minimum of 6 demerit points which will put a severe dent on your driving record. One stunt driving conviction alone can change your life, and not for good. A stunt driving conviction on your record will also ruin your insurance rates.

    One Violation Usually Leads to Another

    The thing with getting busted for traffic violations is that it could lead to you getting charged for more than one offence. Imagine you get pulled over for stunt driving and then the officer finds out that you are driving without a license. At this point, you not only get charged for stunt driving but also for driving without a license. You will end up having to face both charges, put both fines, have your license suspended for longer and get longer jail time.

    The same is the case for every other violation, like Seatbelt violations, license violations, driving under the influence, and so on. When you get pulled over for one violation, it is the officer’s prerogative to check your license, registration and insurance as well as for other violation. A lot of times, people who get pulled over for stunt driving or any other single violation end up with other charges to face asides from the original one they got pulled over.     Your Vehicle Maybe Towed

    As mentioned earlier, your vehicle may be towed and impounded for up to seven days. You are to bear the full cost of all of this.
