Lawyers Helping Drivers with Driving Without Insurance Violations in Ontario

    Drivers without Insurance In Ontario

    Drivers without Insurance In Ontario

Automobile insurance is something the Canadian Government takes very seriously. The

law requires that owners of multiple cars ensure that they have insurance coverage on each of their vehicles. Therefore, driving without insurance in Ontario is something you should not do.

Truthfully, having automobile insurance is mostly for your good. In the world of driving, accidents are inevitable. Sometimes they may be mostly your fault and other times none of your responsibility at all. However, the fact remains that accidents do occur and often costly (money-wise and otherwise). With automobile insurance, you have a safety net to protect you against the unplanned expenses that accidents can present. The Government of Ontario realizes the benefits of automobile insurance and requires that every vehicle owner insure their vehicle. It is a strict law that, when infringed upon, can lead to hefty fines.

Is Driving Without Insurance in Ontario A Crime?

Thankfully, driving without insurance isn’t a criminal offence. Relax, you won’t be spending the night in prison for this, and it won’t be going your criminal record. However, it is an offence, nonetheless.

The Compulsory Automobile Insurance Act of Ontario prohibits drivers from driving without insurance in Ontario. It means even though the Police won’t arrest you as relates to the offence. Nevertheless, you might end up facing a string of hefty fines and penalties as a consequence. The Government of Ontario is very serious about committing the act of Driving Without Insurance in Ontario. At any point in time that you get pulled over by an officer on patrol. He or she will ask for your papers, which include your license, vehicle registration and insurance. You are required by law to provide said documents to the officer of the law. A lot of times, drivers may have their license and registration but not their vehicle insurance. Most of the time, this could spell big trouble with the law. You are not going to be driving home with a smile on your face if this happens. You will even be lucky if you get to drive home in your car at all.

So, before thinking of trying to save money by not protecting yourself with coverage. Think about the risk and consider possible insurance violations in the future. Don’t be pennywise and pound foolish.

Breakdown Of The Compulsory Automobile Insurance Act of Ontario

According to this Act, “no owner or lessee of an automobile shall cause or permit the use of that automobile on a highway unless the owner has duly insured the vehicle under an insurance contract.”  From the above statement, we derive the meaning of not driving around Ontario if we don’t have insurance. Or in the same vein, a vehicle registered in your name should not be caught being operated by anyone.  Even if it isn’t you, no one should drive your car or truck without proper insurance.

It is important to note that the owner or lessee is the person responsible for compliance with this law and not the driver. Unless, of course, the owner and driver are the same people. A driver merely borrowing the vehicle or driving it instead of the owner cannot be held responsible for contravening this law.

The Government And Auto-Insurance In Ontario

The Government in Ontario strictly wants all vehicle owners to have vehicle insurance coverage. As a result, the Ontario government has announced plans to reduce the cost of auto insurance in Ontario. They also plan to provide more options for drivers to make auto insurance more affordable. The idea is to make auto insurance so accessible so people won’t have an excuse not to have insurance. The Government calls this its “putting the driver first” plan.

Also, part of this plan is an intention to reduce the cost of medical treatment, claims processes and legal fees.

The plan makes no specific projections about how much Ontario drivers are likely to save. However, it does raise levels of optimism. The target goal is to reduce the number of red tape drivers have to go through to secure insurance for their vehicles.

Government Plans to Access Affordable Insurance

The Ontario government has started making plans, including centralizing the system to simplify the claims process. As part of the big picture, the initiative is expected to fight fraud, among other things. Also, as part of the plan, those injured in vehicle accidents will be provided with debit-style cards. As said, the injured victims would use the cards for treatment and rehabilitation benefit payments. In essence, it’ll be more convenient for everyone to access affordable vehicle insurance if all rolls out well.

How Much Fines Do the Courts Charge For Driving Without Insurance In Ontario

You may be wondering how much the fine is for getting caught driving without insurance in Ontario. Well, the penalties can be quite high but are a bit more lenient for first-time offenders.

For a first time offence, the fine starts at $5000 and can go as high as $25000.

For subsequent offences, the fine starts at $10,000 and goes as high as $ 50,000.

All of these fines include a 25% surcharge.

The ministry of Ontario sets up these fines so high to serve as deterrents to possible offenders. Honestly, let’s face it, not too many people can afford a $5,000 penalty for a car insurance infringement. It’s just cheaper to get the insurance and be safe about it.

Other Consequences Of Driving Without Insurance In Ontario

Asides fines, offenders face likely drivers’ license suspension for up to one year. In fact, as a first offender, your license will be suspended for a minimum of 30 days. It’s even worse if you keep repeating the same offences. Also, an officer would deem it deliberate and impound your vehicle for as long as three months if you’re relentless. The inconvenience of it all is quite dreadful. You should avoid falling on the wrong side of the CAIA considering the obvious. In summer, some people prefer to ride around on a bicycle to work. A silver lining at least is that you get some exercise from all that walking and cycling. Of course, there are other alternative transportation options in Ontario. Asides from walking and cycling, but then we are trying to paint the worst possible scenario that could occur.

    Avoid Driving Without Insurance Conviction

As if all this isn’t bad enough if convicted of Driving Without Insurance in Ontario.  Such infraction would most likely put you on a “high risk” list with your insurance company. When you fall into a category of a “high-risk driver,” your premiums would go up. You might also risk your insurance policy and possibly have it cancelled for three years.

Given the above circumstances, there’re lessons to learn indeed. It’s not worth the risk of breaching the law by operating a motor vehicle without insurance in Ontario. Advisably, it is always in your best interests as a driver to avoid no-insurance violations.

Presumably, the fines that could arise from a violation doesn’t perturb you. The civil suits and court cases that could emanate from operating a vehicle or permitting its operation without insurance could run into tens of thousands of dollars. So unless you are a multi-millionaire with a lot of money to spare or splurge, also a new penchant for breaking traffic laws, then you would do well to steer clear of no-insurance violations.

Despite all of the above consequences, Traffic Cops still catch people driving without insurance. Sometimes it’s not the fault of people to Drive Without Insurance. There’s a possibility that a driver’s insurance company is still processing the vehicle insurance application. Such instances shouldn’t justify if a driver is at fault. Other times the reasons constitute a driver’s negligence.

    Contact The Traffic Tickets Experts

Principally and in summary, what happens when the Police find you in an Insurance Violation in Ontario. You’ll very much end up losing a lot of money. Unless, of course, you have professional legal backing from experts such as Traffic Tickets Experts to help you fend off the overreaching punitive arms of the traffic-governing laws.

Failure To Show Proof Of Insurance or Driving Without Insurance

    Drivers without Insurance In Ontario

    Drivers without Insurance In Ontario

Your proof of insurance is a pink slip, which shows that you have acquired insurance coverage for your vehicle. It is crucial to carry it with you at all times when you hit the road. Failure to provide it could lead to getting fined. It is advisable to always have your pink slip in your wallet, purse or your glove compartment. That way, you carry it around with you and can produce it whenever and wherever you need to. Always make sure to inform your friends, family, employees or co-workers if lending a car.

The Compulsory Automobile Insurance Act also makes it imperative for you to have your pink slip with you at all times. Any failure to provide it could lead to the officer assuming you do not have any insurance at all. He or she will then go ahead and charge with you driving without insurance. If you are unlucky, the officer will accuse you of failing to provide proof of insurance. A No Insurance Violation could cost anywhere between $2000 and $5000 in fines. In the event when you have forgotten your pink slip at home.

You could attend court and tender the proof of insurance, and the prosecutor would drop charges.

Always Carry Along Your Pink Insurance Slip

If, however, you choose to pay the fine and get on with it, it will go on your driver’s abstract. It could also affect your insurance rates even if you already have insurance on the vehicle.

Again, you could prevent both of these situations by simple due diligence. Always make sure your vehicle and your pink slip are in the same place at the same time. A court date is unnecessary if you have insurance. Imagine having to leave work or school in the middle of the day to attend a court date. Considering the trip to court and the wait, you might have to experience when you get there. Much likely, both will take longer than the actual court hearing itself.  It is annoying and only not worth it.

Driving A Car Without Your Insurance

If you do not have your insurance, but you drive a borrowed car from a family member or friend. You will not get in any trouble as long as the vehicle itself is insured. Generally, as the owner of a motor vehicle, the law requires you to protect the car and not the driver. If you’re thinking of catching a ride with a family member or friend, do remember to ask them whether their automobile is insured. Also, it’s vital to ask where they keep the insurance slip of the car. Once you know these things, you are good to go.

As a vehicle owner, the responsibility is yours to ensure that the driver of your vehicle knows where you keep the pink slip for the car. You don’t want to be charged for a traffic violation when you weren’t even in the car.

It is critical to note that if someone else is caught driving your car with your permission, but without insurance. You will be held responsible for letting your vehicle on the road without insurance. As such, the cops will charge you accordingly.

Getting Involved In An Accident While Driving Without Insurance In Ontario

Driving an automobile in and involving in an accident is the worst thing that could happen to you while driving without insurance in Ontario. In such a circumstance, because you have no insurance protection, you will have to shoulder the cost of all repairs to your car and any medical bills you may accrue.  To compound matters, the courts will charge you for driving without insurance as well as fine for the accident itself if found at fault. Try and imagine how awful it would be if you hit a pedestrian while operating a motor vehicle without insurance. Worse still, imagine crashing into another automobile or getting hit by another driver driving a car without insurance. All of these are terrible circumstances every driver should avoid.

However, having insurance protects you from the costs that come with being involved in an accident.  Even if someone hits your vehicle by accident and doesn’t have any insurance, you are still protected.

Your Insurability After Driving Without Insurance

After an officer has charged or summoned you for driving without insurance, you might want to secure insurance after the fact though such a move helps after the fact. It still proves a tricky proposition since the status of your driving records categorizes you as a high risk by insurers. Most insurers will not offer you any coverage, and those that do will offer them at extremely high rates.

It just might be quite a lot to handle if you get slapped with driving without insurance violation. In that case, you should know you’ll need some legal help “un-sticking” those charges.
